If the Dispute cannot be resolved informally within thirty (30) days, either party may pursue resolution through the courts of British Columbia as described in Section 9 above, or the parties may mutually agree to submit the Dispute to binding arbitration in Surrey, British Columbia, administered in accordance with the rules of the British Columbia International Commercial Arbitration Centre (BCICAC) or another mutually agreed-upon arbitration body.

Nothing in this section shall prevent either party from seeking injunctive or other equitable relief from the courts as necessary to protect the party's intellectual property rights or confidential information.

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole. Such provisions shall be deleted or modified to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
